Due Diligence Analysis and Litigation Support

  • Assisted Jazz Aviation LP (Air Canada Regional Partner) In the Matter of an Arbitration of Disputes Arising Out of a Capacity Purchase Agreement Between Air Canada, Jazz Air Limited Partnership and Jazz Air Holding GP Inc. Provided counsel with advice about airline industry practices and opinions with respect to a number of issues within the context of the Arbitration, and assisted the testifying expert in the preparation of an expert report. Also provided advice to counsel including during testimony of the opposing expert witnesses.

  • Analyzed operational and cost data to determine scope of damages suffered by client following an airline’s premature termination of its contract with the company. Advised counsel during settlement negotiations.

  • Performed Due Diligence analysis of America West’s proposed operating plan in support of the carrier’s successful loan application to U.S. Air Transportation Stabilization Board.

  • Participated in analyses and prepared for production of expert report and testimony in lawsuit concerning the shutdown of Emery Worldwide Airlines. Lawsuit settled prior to deposition/trial.

  • Led consulting team that performed due-diligence analysis of major cargo client’s strategic re-orientation.

  • Managed and participated in analyses of commercial aerospace strategic issues and business cases, including associated economic analysis.

  • Prepared analyses of American, Delta and United fleets in the event of Chapter 11 bankruptcy for investor in “distressed” securities.

  • Performed analysis of and prepared expert report about Midwest Express Airlines planning/aircraft acquisition activities for Fairchild-Dornier’s counsel, in conjunction with lawsuit concerning the Fairchild-Dornier 428 aircraft.

  • Reviewed Western Pacific’s route & fleet plans for aircraft manufacturer; later, provided Due Diligence opinion of strategic alternatives for the carrier’s Board of Directors re the airline’s movement of its operations hub from Colorado Springs to Denver.

  • Prepared and supervised numerous analyses of Air New Orleans’ operations, financial results and fleet planning activities in lawsuit for ATR’s counsel; deposed as an expert witness.

  • Assisted secured creditor (Saab Aircraft) in evaluating Business Express’s business plans, including providing expert witness testimony about slot valuation before the Bankruptcy Court. Business Express emerged successfully from Chapter 11 bankruptcy and was subsequently acquired by American Airlines.

  • Prepared and supervised numerous analyses of MarkAir’s operations and financial results in support of litigation, for Alaska Airlines’ counsel.

  • Provided expert opinion and was deposed about regional airline industry and equipment financing issues regarding Atlantic Coast Airlines’ motion to the bankruptcy court to compel United to affirm or reject Atlantic Coast’s existing contract on an expedited basis. Judge ruled in favor of client (United Airlines) after reviewing Hamlin’s deposition.

  • Prepared expert opinion and was deposed about dispute between an investor and a proposed airline with respect to fleet and market planning issues. Case settled prior to trial in favor of client.
